These General Terms & Conditions (“Terms”) apply to bookings made with The Wild Path and govern the relationship between The Wild Path and each person who books or participates in an expedition, experience, or related service offered by us.
By making a booking, submitting payment, or participating in an expedition, you acknowledge that you have read and accepted these Terms, together with any expedition-specific conditions disclosed before booking.
1. About The Wild Path
The Wild Path designs and coordinates small-group nature, wildlife, and adventure expeditions. Depending on the expedition, experiences may involve independent local operators, guides, captains, accommodation providers, transportation providers, equipment providers, and other third parties. Our experiences are built around real natural environments. Conditions, wildlife, weather, accessibility, and itineraries may therefore change.
2. General Terms & Expedition-Specific Conditions
These Terms establish the general conditions applicable to The Wild Path bookings. Each expedition may establish additional or specific conditions, including: Dates and duration; Price; Reservation deposit; Payment schedule; Included and excluded services; Participant requirements; Minimum or maximum group size; Cancellation conditions where different from these Terms; Equipment requirements; Meeting points and transportation arrangements; Other conditions particular to the destination or activity. These conditions will be disclosed on the applicable expedition page, during the booking process, or otherwise communicated before payment. By completing a booking, you accept both these Terms and the expedition-specific conditions presented to you before booking. If an expedition-specific condition clearly disclosed before booking conflicts with these General Terms, the expedition-specific condition will apply to that booking.
3. Booking & Reservation
A booking is confirmed only after the required reservation payment or deposit has been successfully received and The Wild Path has issued or displayed confirmation of the booking. Submitting an inquiry, joining a waiting list, discussing an expedition with us, or expressing an intention to participate does not reserve a spot unless expressly confirmed by The Wild Path. Availability is limited and bookings are subject to available capacity. If one person books multiple spots, that person is responsible for providing accurate information regarding the booking. Each individual participant must independently satisfy applicable participation requirements and complete any required documentation or waiver.
4. Prices, Deposits & Payment Schedule
The total price, applicable taxes, required deposit, and payment schedule for each expedition will be disclosed before booking. Any reservation deposit forms part of the total expedition price unless expressly stated otherwise. Remaining balances must be paid by the deadline disclosed for the applicable expedition. If a required balance is not received by its due date, The Wild Path may, after reasonable notice to the guest, cancel the reservation and release the spot. We will make reasonable efforts to contact the booking guest before releasing a reservation for non-payment.
5. Taxes, Currency & Payment Charges
Prices will identify applicable taxes as required. Payments may be processed through third-party payment providers and may be available through different payment methods depending on the expedition. Your bank, card issuer, payment provider, or currency-conversion provider may impose additional fees, exchange-rate adjustments, international transaction charges, or other costs. These charges are outside The Wild Path’s control and are the guest’s responsibility.
6. Guest Cancellations
Unless different payment or cancellation conditions are clearly disclosed for a particular expedition before booking, the following general policy applies.
Payment Options. Where offered, guests may reserve their spot by paying the required reservation deposit or may choose to pay the full expedition price at the time of booking. The applicable deposit amount, total expedition price, and payment options will be clearly disclosed before payment.
Remaining Balance. Where a guest books using a reservation deposit, the remaining balance must be paid no later than 30 days before the expedition start date, unless a different deadline is clearly disclosed for the particular expedition. Failure to pay the remaining balance by the applicable deadline may result in cancellation of the reservation.
More than 30 days before the expedition start date. Cancellations made more than 30 days before the expedition start date are eligible for a 100% refund of amounts paid to The Wild Path for the cancelled booking, including any reservation deposit or full payment.
30 days or less before the expedition start date. All amounts paid become non-refundable for cancellations made 30 days or less before the expedition start date.
We understand that plans can change. Guests cancelling within the non-refundable period may have the alternatives described in Sections 7 and 8 below.
7. Transfer Your Spot
For a cancellation occurring within the non-refundable period, the guest may request to transfer the reservation to another person without a transfer penalty from The Wild Path. The replacement participant must: Meet the expedition’s eligibility and safety requirements; Provide all required information; Accept the applicable Terms; Complete and sign any required waiver or documentation; Complete any other requirement applicable to the expedition. Transfers may be subject to limitations imposed by third-party providers where bookings, permits, accommodations, tickets, or other services have already been issued in a specific person’s name. Any third-party cost directly resulting from the transfer may be charged to the guest.
8. Future Expedition Discount
If a guest cancels within the non-refundable period and cannot reasonably transfer their spot, The Wild Path will provide that guest with a 30% discount on one future The Wild Path expedition. Unless otherwise agreed in writing: The discount must be used within 12 months of the original expedition start date. It is personal and non-transferable. It may be used once. It cannot be combined with other promotions or discounts. It is subject to availability. It does not represent cash value or a refund of the cancelled booking. The discount applies to the eligible future expedition price charged by The Wild Path and does not necessarily apply to optional add-ons or separately priced third-party services.
9. Minimum Participation
Unless otherwise stated for a particular expedition, The Wild Path expeditions require a minimum of three paying guests to operate. If the minimum participation requirement is not reached, The Wild Path may offer affected guests: A different departure date; A comparable expedition or experience; Credit toward another The Wild Path expedition; A full refund of amounts paid to The Wild Path. If the guest does not reasonably accept an offered alternative, the guest may choose the full refund. When minimum participation applies, we will make reasonable efforts to communicate any resulting change or cancellation as early as practicable. The Wild Path is not responsible for independently booked flights, transportation, accommodation, or other consequential expenses resulting from cancellation due to insufficient participation. Travel insurance is therefore strongly recommended.
10. Weather, Ocean & Natural Conditions
Nature determines what is possible. Weather, ocean conditions, visibility, currents, swell, storms, port closures, fires, trail conditions, natural hazards, or other environmental circumstances may require an activity to be delayed, modified, relocated, rescheduled, or cancelled. Safety takes priority over the planned itinerary. When conditions prevent an activity from operating as planned, our first preference will be to find a reasonable alternative. Depending on the circumstances, this may include: Adjusting the timing or itinerary during the existing expedition; Rescheduling the affected activity; Offering another reasonable date; Providing credit toward a future experience; or Where those alternatives are not reasonably practical, considering an appropriate refund. For example, where an international guest must leave the destination and cannot reasonably return for a rescheduled activity, a refund may be an appropriate solution. Any refund relating to weather, natural conditions, or circumstances outside The Wild Path’s control may take into account genuine non-recoverable costs already committed to third-party providers. The Wild Path will make reasonable efforts to recover, reschedule, or obtain credit for third-party costs before determining the amount that can reasonably be returned to the guest.
11. Wildlife Encounters
Wildlife is wild. The Wild Path does not guarantee the presence, behavior, proximity, number, or visibility of any animal or species. References to particular wildlife on an expedition page describe the purpose, season, habitat, historical patterns, or reasonable objective of the expedition — not a guaranteed encounter. Successfully operating an expedition without encountering a particular species does not constitute cancellation or failure to provide the expedition and does not by itself create a right to a refund or credit. We believe this unpredictability is part of experiencing nature responsibly.
12. Changes to the Itinerary
The Wild Path may reasonably modify an itinerary when necessary due to weather, safety, wildlife activity, local conditions, transportation, availability, instructions from authorities, operational requirements, or circumstances beyond our reasonable control. Changes may include adjustments to: Activity times; Meeting points; Routes; Activity order; Locations; Boats or vehicles; Accommodation; Guides or local operators; Individual activities. Where reasonably possible, we will seek to preserve the overall character and purpose of the expedition. A reasonable itinerary modification does not automatically create a right to a refund.
13. Cancellation or Material Changes by The Wild Path
If The Wild Path cancels an expedition for reasons within our reasonable control and cannot provide a reasonable alternative, affected guests may choose between: A full refund of amounts paid to The Wild Path for the cancelled expedition; or Credit toward a future The Wild Path expedition. This provision is separate from cancellations or changes caused by weather, natural conditions, force majeure, minimum participation requirements, or other circumstances addressed elsewhere in these Terms. Unless required by applicable law, The Wild Path is not responsible for independently purchased flights, transportation, accommodation, visas, equipment, or other expenses outside the booking made with us.
14. Participant Responsibilities & Fitness to Participate
Adventure and wildlife activities may require particular physical abilities, swimming skills, experience, judgment, or comfort in natural environments. Guests are responsible for reviewing the requirements of an expedition and determining whether they reasonably meet them. Participants must provide accurate information concerning circumstances that may materially affect their safe participation. Payment, booking confirmation, or execution of a waiver does not guarantee participation in every activity. The Wild Path, expedition leaders, guides, captains, instructors, or local operators may modify, restrict, or deny a participant’s involvement in an activity when reasonably considered necessary to protect the safety of that participant, other guests, crew, wildlife, or the expedition. Such decisions will be based on reasonable safety considerations rather than discriminatory criteria.
15. Health & Medical Information
Where reasonably necessary for safety, participants may be asked to provide limited health or medical information relevant to participation. Participants are responsible for disclosing relevant circumstances accurately. The Wild Path does not provide medical advice and the acceptance of a booking should not be interpreted as a medical determination that a participant is fit for an activity. Where appropriate, guests should consult a qualified medical professional regarding their ability to participate. Personal and sensitive information will be handled in accordance with our Privacy Policy.
16. Safety Instructions & Guest Conduct
Participants must comply with reasonable safety and operational instructions provided by The Wild Path, expedition leaders, captains, guides, instructors, local operators, or relevant authorities. We may restrict or remove a participant from an activity where conduct reasonably presents a danger to the participant, other guests, crew, wildlife, property, or the environment. Examples include: Repeatedly ignoring safety instructions; Dangerous or reckless conduct; Harassment, threats, or abusive behavior; Deliberately damaging property or the environment; Inappropriate interaction with wildlife; Participation while materially impaired by alcohol or drugs; Conduct that substantially disrupts the expedition or compromises the safety of the group. Where participation is restricted or terminated because of serious conduct attributable to the guest, the affected activity or remaining expedition is not automatically eligible for refund.
17. Wildlife & Environmental Responsibility
Participants must respect wildlife, natural habitats, protected areas, local regulations, and instructions designed to minimize environmental impact. Guests may be instructed regarding matters such as: Appropriate distance from wildlife; When and where entering the water is permitted; Touching or pursuing wildlife; Drone use; Waste and pollution; Reef or habitat protection; Restricted areas; Local conservation rules. The Wild Path may stop an activity or restrict a participant whose behavior threatens wildlife, habitats, or the responsible operation of the expedition. Access to nature does not create a right to interfere with it.
18. Alcohol, Drugs & Impairment
Responsible consumption outside expedition activities is not prohibited unless expedition-specific rules state otherwise. However, participants may not participate in an activity while materially impaired by alcohol, recreational drugs, improperly used medication, or another substance that may compromise judgment, coordination, awareness, or safety. A participant may be excluded from an activity where an expedition leader, captain, guide, instructor, or operator reasonably considers the participant impaired.
19. Minors
Minors may participate when the nature of the expedition, applicable regulations, activity requirements, and safety considerations allow. A parent or legal guardian must make or authorize the applicable arrangements and provide any required consent on behalf of the minor. The parent or legal guardian must complete any waiver, acknowledgment, medical disclosure, or other documentation required for the minor. Parental consent does not override safety requirements. Participation may still be modified or denied when reasonably necessary for the minor’s safety or the safety of others.
20. Travel Insurance
The Wild Path strongly recommends obtaining appropriate travel insurance. Depending on the expedition, guests should consider coverage for: Trip cancellation or interruption; Medical emergencies; Emergency evacuation or repatriation; Travel delays; Lost or damaged baggage; Adventure or water activities relevant to the expedition. Unless expressly stated otherwise for a particular expedition, insurance is recommended rather than mandatory. A guest who chooses to travel without insurance accepts responsibility for costs that could otherwise have been covered by an appropriate policy. The Wild Path may provide information regarding third-party insurance options in the future, but any insurance contract is between the guest and the applicable insurer unless expressly stated otherwise.
21. Travel Documents & Personal Arrangements
Guests are responsible for obtaining and maintaining all documents and permissions necessary for their travel, including where applicable: Passports; Visas; Immigration documents; Health documentation; Permits; Licenses; Any other governmental requirements. Unless expressly included in the expedition description, guests are also responsible for arranging transportation to and from the designated meeting location or accommodation. The Wild Path will provide relevant meeting information and instructions before the expedition.
22. Included & Excluded Services
The applicable expedition page or booking information will describe what is included and excluded from the expedition price. Unless expressly listed as included, guests should not assume that flights, transportation, equipment rental, meals, insurance, gratuities, personal purchases, visas, or other ancillary expenses form part of the booking. Services specifically advertised as included form part of the expedition booking, subject to reasonable substitutions where circumstances require.
23. Timeliness & Missed Activities
Participants are responsible for arriving at meeting points and activities at the communicated time. Because many activities depend on boats, tides, weather windows, permits, wildlife conditions, group logistics, or third-party schedules, departures may not be able to wait for late participants. The Wild Path will make reasonable efforts to assist where practical, but activities missed due to a participant’s delay or failure to arrive are not automatically eligible for refund or replacement.
24. Equipment & Personal Belongings
Guests are responsible for their personal belongings and equipment, including cameras, drones, phones, dive or snorkeling equipment, luggage, documents, and other valuables. Adventure environments may expose equipment to water, salt, sand, impact, weather, loss, theft, or other hazards. Where The Wild Path or a third party provides rented or loaned equipment, participants must use it responsibly and return it in reasonable condition. Guests may be responsible for loss or damage resulting from misuse, negligence, or failure to return provided equipment, subject to applicable law.
25. Accessibility & Special Requirements
We want guests to contact us before booking if they have accessibility requirements, dietary requirements, physical limitations, or other circumstances requiring special arrangements. The Wild Path will make reasonable efforts to accommodate requests where practical. However, because some expeditions take place in remote locations, small boats, natural terrain, open water, or environments with limited infrastructure, not every activity or destination can accommodate every requirement. We encourage guests to speak with us before booking so that we can assess the expedition together.
26. Independent Service Providers
The Wild Path may arrange or coordinate services provided by independent third parties, including accommodation providers, captains, guides, transportation providers, equipment providers, and local operators. Those providers may be subject to their own operational rules, safety requirements, and terms. The Wild Path will use reasonable care when selecting and coordinating providers but cannot control every act or omission of an independent third party. Nothing in these Terms is intended to exclude responsibility that cannot lawfully be excluded.
27. Problems During an Expedition
If a problem arises during an expedition, guests should inform The Wild Path or an expedition leader as soon as reasonably possible. Early notice gives us an opportunity to investigate and, where possible, resolve the issue while the expedition is still taking place. We encourage guests to contact us directly before initiating a payment dispute or other escalation so that we have a reasonable opportunity to understand and address the issue. Nothing in this section limits any consumer or legal right that cannot lawfully be waived.
28. Waiver & Acknowledgment of Risk
Certain expeditions or activities require participants to review and sign a separate Waiver & Acknowledgment of Risk before participating. The waiver is separate from these commercial Terms. Each participant must complete the required waiver individually, except where a parent or legal guardian is legally permitted to execute documentation on behalf of a minor. A booking made by one person for multiple guests does not constitute acceptance of a waiver by those other participants. Failure to complete required documentation may prevent participation without creating an automatic right to a refund.
29. Photography, Video & Media
The Wild Path may photograph or record natural environments, wildlife, expedition activities, and the overall experience. The identifiable likeness of a participant will not be intentionally used for promotional or commercial purposes solely because that person purchased or participated in an expedition. Where appropriate, separate consent for identifiable promotional use may be requested through a media release, waiver, or other clearly presented mechanism. Declining optional promotional media consent does not by itself prevent participation in an expedition. Participants may also create personal photographs and video, subject to safety instructions, wildlife rules, local regulations, and any expedition-specific restrictions.
30. Intellectual Property
The Wild Path name, logo, website design, written content, photographs, videos, graphics, expedition materials, and other original content are owned by The Wild Path or used with permission from their respective rights holders. Booking or participating in an expedition does not transfer ownership or commercial usage rights in The Wild Path intellectual property. Unauthorized commercial reproduction or use is prohibited subject to applicable law.
31. Electronic Communications & Signatures
Guests agree that booking confirmations, payment communications, notices, waivers, policies, and other expedition documentation may be provided electronically. Where permitted by applicable law, electronic acceptance, checkboxes, electronic signatures, and comparable electronic records may be used to document consent or agreement. Guests are responsible for providing accurate contact information and monitoring the email address or other contact method supplied during booking.
32. Errors & Corrections
We make reasonable efforts to ensure that expedition descriptions, dates, prices, and other website information are accurate. However, genuine typographical, technical, pricing, or publication errors may occur. If a material and obvious error affects a booking, The Wild Path may correct the error and will give the affected guest a reasonable opportunity to: Continue the booking under the corrected terms; or Cancel the affected booking and receive a refund of amounts paid to The Wild Path. This provision does not permit The Wild Path to arbitrarily increase an agreed price after booking.
33. Force Majeure
Events outside reasonable control may prevent or materially affect an expedition. These may include natural disasters, hurricanes, severe weather, fires, earthquakes, epidemics, government restrictions, port or border closures, civil unrest, transportation shutdowns, or comparable extraordinary circumstances. Where such an event occurs, The Wild Path will make reasonable efforts to provide an appropriate solution, which may include itinerary modification, postponement, rescheduling, credit, or refund where appropriate. Any refund may take into account legitimate non-recoverable amounts already paid or committed to third-party providers. The Wild Path will make reasonable efforts to recover or obtain credit for such amounts where practicable.
34. Limitation of Liability
Adventure, wildlife, travel, boating, water-based, and outdoor activities involve inherent risks that cannot be completely eliminated. Participants are expected to understand and accept the ordinary inherent risks associated with the activities in which they voluntarily participate, as further described in any applicable Waiver & Acknowledgment of Risk. Nothing in these Terms is intended to exclude, restrict, or waive liability or consumer rights where doing so would be prohibited by applicable law. The scope of any release or assumption of risk applicable to a particular activity will be addressed separately in the applicable waiver.
35. Changes to These Terms
The Wild Path may update these Terms as our expeditions, operations, legal requirements, or business practices evolve. The current version will be available at: thewildpath.world/terms The “Last updated” date will identify the current version. Unless required by law or agreed with the guest, material changes to these Terms will not retroactively alter the essential commercial conditions of an existing confirmed booking. The terms and expedition-specific conditions accepted at the time of booking will generally govern that booking.
36. Entire Agreement & Order of Precedence
The agreement applicable to a booking may consist of: These General Terms & Conditions; Expedition-specific conditions disclosed before booking; The booking confirmation and agreed payment information; and Any separately executed waiver or other agreement applicable to participation. Expedition-specific commercial conditions clearly disclosed before booking prevail over conflicting general commercial provisions for that expedition. A Waiver & Acknowledgment of Risk governs risk acknowledgment and participation matters within its scope but does not independently modify the price or other commercial terms of the booking unless expressly stated.
37. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. The affected provision should be interpreted or limited, where legally possible, in a manner that most closely reflects its lawful intended purpose.
38. Applicable Law
These Terms and bookings with The Wild Path are governed by the applicable laws of Mexico. Nothing in these Terms limits any mandatory consumer protection or other legal rights available to a guest under applicable law. Any jurisdiction or dispute-resolution provisions applicable to The Wild Path bookings may be further specified before commercial launch following legal review.
