01. Information We Collect
The Wild Path collects personal information that is reasonably necessary to provide our services, manage bookings, communicate with participants, operate expeditions, and maintain the safety of our guests. Depending on how you interact with us, we may collect: Full name; Email address; Telephone number; Date of birth; Booking and expedition information; Payment and transaction information; Communications you send to us; Emergency contact name and telephone number; Information provided through forms, waivers, or other pre-expedition documentation; Technical information generated when you interact with our website, where applicable. If you provide information about an emergency contact, you confirm that you are authorized to provide that information for emergency and safety purposes. We seek to collect only information that is relevant and reasonably necessary for the purposes described in this Privacy Policy.
02. Sensitive Personal Data
Certain expeditions involve activities such as open-water swimming, snorkeling, freediving, boat travel, remote environments, physical exertion, and encounters with wildlife. For safety purposes, we may ask participants to disclose limited health or medical information relevant to their ability to safely participate, including, where appropriate: Medical conditions that may affect participation; Allergies relevant to an emergency; Medications relevant to participant safety; Physical limitations or other circumstances that may materially affect participation in an expedition activity. Health information may constitute sensitive personal data under applicable law. We request such information only when reasonably necessary for participant safety and will obtain any consent required for its processing. We will not use health information for advertising or marketing purposes. Participants are responsible for providing accurate and relevant information regarding circumstances that may affect their safe participation. Providing medical information or signing a waiver does not guarantee participation in any particular activity. The Wild Path, its expedition leaders, guides, captains, or local operators may restrict, modify, or deny participation in an activity when reasonably considered necessary for the safety of the participant, other guests, crew, wildlife, or the expedition. We aim to retain sensitive personal information only for as long as reasonably necessary for the purpose for which it was collected and any applicable legal requirements.
03. How We Use Your Information
We may use personal information to: Process and manage reservations; Process payments and maintain transaction records; Communicate with you regarding your booking; Provide pre-expedition information, instructions, schedules, and updates; Evaluate and support safe participation in expedition activities; Respond to questions and provide customer support; Coordinate accommodations, transportation, guides, local operators, and other services included in an expedition; Respond to emergencies and contact designated emergency contacts when reasonably necessary; Prevent fraud, abuse, or unauthorized transactions; Maintain business, accounting, tax, and operational records; Comply with applicable legal and regulatory obligations; Establish, exercise, or defend legal claims. We will not use personal information for purposes materially incompatible with those described here without obtaining any additional consent required by applicable law.
04. Payments
Payments for The Wild Path experiences and products may be processed by third-party payment providers, including Stripe. Payment providers may collect and process payment card details, banking information, billing information, fraud-prevention data, and other information necessary to complete a transaction. The Wild Path does not store complete payment card numbers or card security codes on its own systems. We may receive transaction-related information from payment providers, such as your name, email address, payment status, transaction amount, payment method type, and transaction identifiers, as necessary to manage your reservation, provide support, maintain financial records, and comply with applicable obligations. Payment information processed directly by a third-party payment provider is also subject to that provider’s applicable privacy practices.
05. Service Providers & International Processing
The Wild Path may use third-party service providers to operate our website, process payments, manage communications, obtain electronic signatures, manage reservations, provide technology infrastructure, prevent fraud, or otherwise support our operations. These providers may process personal information on our behalf or under their own applicable terms and privacy policies. Some providers may process or store information outside Mexico. Accordingly, personal information may be processed in jurisdictions other than the jurisdiction in which it was originally collected. Where required by applicable law, The Wild Path will take appropriate measures regarding transfers and processing of personal information by third parties. We do not sell personal information to third parties.
06. Communications & Marketing
We may contact you when reasonably necessary in connection with a reservation or expedition. These communications may include: Booking confirmations; Payment information; Expedition updates; Schedule or itinerary changes; Weather or safety information; Waivers and required documentation; Pre-departure instructions; Important post-expedition communications. These operational communications are separate from marketing communications. Booking an expedition does not automatically subscribe you to marketing communications from The Wild Path. If you choose to subscribe to expedition announcements, stories, newsletters, or other marketing communications, you may unsubscribe at any time using the mechanism provided in those communications or by contacting us. Unsubscribing from marketing does not prevent us from sending communications reasonably necessary to manage an existing reservation or fulfill our obligations to you.
07. Cookies & Website Data
Our website and the technology providers used to operate it may use cookies or similar technologies that are necessary for website functionality, security, performance, payments, or related services. At this time, The Wild Path does not intentionally use third-party advertising pixels or advertising tracking technologies installed by us. If we later introduce analytics, advertising, or other tracking technologies that materially change how website data is collected or used, we will update this Privacy Policy and implement any consent or disclosure mechanisms required by applicable law. Your browser or device may also provide tools for controlling certain cookies or website permissions.
08. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected and to satisfy applicable legal, tax, accounting, contractual, safety, dispute-resolution, and recordkeeping requirements. Different categories of information may therefore be retained for different periods. When personal information is no longer necessary and applicable retention requirements have expired, we will take reasonable steps to delete, anonymize, or otherwise appropriately dispose of it. Sensitive personal information will be subject to particular consideration so that its processing period is limited to what is reasonably necessary.
09. Data Security
The Wild Path takes reasonable administrative, technical, and physical measures appropriate to the nature of the information we process and the risks associated with its unauthorized access, loss, alteration, disclosure, destruction, or misuse. No website, electronic transmission, or storage system can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security. If a security incident involving personal information occurs and applicable law requires notification, we will take appropriate steps to notify affected individuals and address the incident.
10. Your Privacy Rights
Subject to applicable law, you may exercise your rights of Access, Rectification, Cancellation and Opposition (ARCO) regarding your personal information. These rights may allow you to: Access personal information we hold about you and obtain information regarding its processing. Rectify inaccurate or incomplete personal information. Cancel personal information when its continued processing is no longer appropriate, subject to applicable legal or contractual retention requirements. Oppose certain processing of your personal information where applicable. You may also request information about available mechanisms to limit the use or disclosure of your personal information or withdraw consent where withdrawal is legally available. We may request reasonable information necessary to verify your identity or authority to act on behalf of another person. Exercising one ARCO right does not prevent you from exercising another.
11. Children & Minors
The Wild Path experiences are not necessarily restricted to adults. Minors may participate in expeditions when the nature of the expedition, activity requirements, applicable rules, and safety considerations permit their participation. A parent or legal guardian must make or authorize the applicable arrangements for a minor and provide any required consents relating to the minor’s personal information and participation. Where health or other sensitive personal information concerning a minor is necessary for safety, we will seek the applicable consent from the parent or legal guardian. Participation by a minor may require a parent or legal guardian to complete and sign additional waivers, acknowledgments, or documentation on the minor’s behalf. Parental or guardian consent does not override safety requirements. The Wild Path and the applicable expedition leaders, guides, captains, or operators may restrict or deny a minor’s participation in an activity when reasonably considered necessary for safety.
12. Third-Party Services
Our website, booking process, or communications may contain links to or integrations with third-party websites and services, including payment processors, electronic-signature providers, local operators, accommodation providers, or other services involved in an expedition. When you interact directly with a third-party service, that provider may process information according to its own privacy practices. The Wild Path is not responsible for the independent privacy practices of third-party websites or services that we do not control. We encourage you to review the applicable privacy information provided by those services when appropriate.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our operations, services, technology, legal requirements, or privacy practices. Where required by applicable law or where a change materially affects how we process personal information, we may provide additional notice or request additional consent as appropriate.
